This agreement is between AcroSource AB 556767-6266] ("AcroSource", "we") and you, an invited beta tester, and governs your use of the HALYard beta application and services (the "Beta").
HALYard is a pre-release marine assistant application, including an AI assistant, voyage logbook, checklists, charts, and man-overboard (MOB) logging aids. The Beta is provided free of charge, for evaluation, and is not a finished product: it may contain errors, may be interrupted, may lose data, and features may change or be removed without notice.
HALYard is a planning, logging, and situational-awareness aid. It is not a navigation device, not a certified chart system, and not certified safety or life-saving equipment.
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Beta on your own devices for evaluation during the beta period. You may not distribute the Beta, reverse engineer it except as permitted by law, or use it to build a competing product.
Processing of personal data (including position tracks and voyage logs) is described in the HALYard Beta Privacy Notice, which you should read. By using the Beta you acknowledge that pre-release software carries elevated risk of data loss; do not rely on the Beta as the sole record of anything important. [Cross-reference: log data is designed to be append-only and synced, but no guarantee is given during beta.]
You may (and are encouraged to) submit feedback, including in-app reports. You grant AcroSource a perpetual, irrevocable, royalty-free license to use feedback for any purpose, without obligation or attribution. Feedback reports include recent conversation context and technical diagnostics, shown to you before sending.
The Beta, its features, and non-public information about it are confidential. Please do not publicly post builds, screenshots, or detailed feature descriptions without our written OK (a short email is fine). This does not restrict discussing your general impressions privately or anything already public.
To the maximum extent permitted by applicable law, the Beta is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or availability.
To the maximum extent permitted by applicable law: AcroSource is not liable for indirect, incidental, or consequential damages, loss of data, or loss arising from reliance on Beta output (including AI-generated content and safety/logging features); and our total aggregate liability under this agreement is limited to SEK 1,000.
This agreement runs for the beta period. Either party may terminate at any time; we may suspend or end the Beta or your access at our discretion. On termination, stop using the Beta. Sections 2, 5, 6, 7, 8, and 10 survive. Data handling after termination follows the Privacy Notice.
This agreement is governed by Swedish law; disputes are subject to the courts of Stockholms Tingsrätt, without prejudice to mandatory consumer rights. If any provision is unenforceable, the remainder stands. This is the entire agreement regarding the Beta.
